These Terms of Service ("Terms") govern your access to and use of billflow.com (the "Site") and any marketing services provided by Billflow ("Billflow," "we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms.
By accessing the Site, submitting a form, or signing a proposal or statement of work with Billflow, you confirm that you have the authority to agree to these Terms on behalf of yourself or the business you represent.
Billflow provides digital marketing services, which may include search engine optimization, paid media management, content and creative production, email and CRM lifecycle marketing, conversion rate optimization, and analytics and reporting. The specific scope, deliverables, timeline, and fees for any engagement will be described in a separate proposal, statement of work, or order form ("Order Form"), which is incorporated into these Terms by reference.
To deliver our services effectively, clients agree to:
Fees for services are set out in the applicable Order Form and may be structured as a one-time project fee, a monthly retainer, or a performance-based fee. Unless otherwise agreed in writing:
Refunds, where applicable, are governed by our Refund & Return Policy.
Upon full payment, clients receive ownership of final campaign deliverables created specifically for them (such as ad creative, landing pages, and content), excluding any pre-existing tools, templates, methodologies, or proprietary processes owned by Billflow, which remain our property. Billflow may reference completed work in its portfolio and marketing materials unless the client requests otherwise in writing.
Both parties agree to keep confidential any non-public business, financial, or technical information disclosed during the engagement, and to use it only for the purpose of performing the services, except as required by law.
Marketing results depend on many factors outside our control, including market conditions, competition, platform algorithm changes, and the client's own product, pricing, and operations. Billflow does not guarantee specific rankings, traffic, leads, sales, or revenue outcomes, and any figures discussed in proposals or reports are estimates based on available data, not guarantees.
To the maximum extent permitted by law, Billflow's total liability arising out of or relating to these Terms or any services will not exceed the total fees paid by the client to Billflow in the three months preceding the event giving rise to the claim. Billflow will not be liable for indirect, incidental, special, or consequential damages, including lost profits or lost data, even if advised of the possibility of such damages.
Either party may terminate an ongoing engagement in accordance with the notice period stated in the applicable Order Form, or with 30 days' written notice if no notice period is specified. Fees for work performed and expenses incurred prior to termination remain due. Sections relating to payment, intellectual property, confidentiality, and limitation of liability survive termination.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles, unless otherwise required by applicable local law.
We may update these Terms from time to time. Material changes will be reflected by a revised effective date on this page. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
